Danish Data Law Should be Suspended, Thinktank Says

An influential Danish think tank has issued a legal opinion calling for the repeal of Denmark’s two-year-old Data Retention Law. Based on the EU’s Data Retention Directive, the law obliges telecoms and other companies to retain certain personal data for a year after it is collected.
According to the center right thinktank CEPOS, the law is a “fiasco” which has had a “very limited impact” in its stated aim of fighting terrorism. However, it has led to a “massive registration of personal data” which likely breaches EU privacy rules.
Against this background, CEPOS Chief Lawyer Jacob Mchangama writes, Denmark should suspend the law pending reviews at both national and EU level. Sweden, he points out, has deferred implementation due to the “complex and fundamental” issues it raises, while Germany’s Constitutional Court has declared it illegal. Implementation has so far cost the Danish telecommunications industry around DKK 300 million, Mchangama adds.
"The law has at best had a very limited impact on fighting terrorism in Denmark. This is disproportionate with the comprehensive registration of personal data and the high associated costs,” Mchangama says. .
